1. Seller and scope
These terms and conditions apply to all sales made on cardreamtcg.com by Card Dream, SASU with a share capital of €50,000, registered with the RCS Le Mans under number 919 148 601, whose registered office is at 17 Chemin de Boulanderie, 72440 Bouloire, France (VAT: FR43919148601, email: hello@cardreamtcg.com).
They apply to purchases made by consumers. By placing an order, the customer confirms that they have read and accepted these terms.
2. Products
Card Dream sells official, factory-sealed Pokémon TCG products, sourced from official distributors. Products are described and shown as accurately as possible; photos are not contractual. Offers are valid while stocks last.
For some high-demand releases, the quantity that can be purchased per customer may be limited. This limit is indicated on the product page.
3. Prices
Prices are shown in euros, including VAT. Shipping costs are shown before the order is confirmed: €14.90 per order, free for orders of €100 or more. For deliveries outside the European Union, customs duties, import taxes and fees are charged by the destination country and paid by the recipient.
Card Dream may change its prices at any time; the products are invoiced at the price in force when the order is placed.
4. Orders
The customer selects the products, checks the content of the cart, provides the delivery details, chooses a payment method and confirms the order with an obligation to pay. The contract is concluded when Card Dream sends the order confirmation by email.
Card Dream may refuse or cancel an order from a customer with whom there is an earlier dispute, or an order that exceeds a purchase limit or appears abnormal. In that case, any amount paid is refunded in full.
5. Pre-orders
Pre-order products are paid when the order is placed; the payment secures the customer’s allocation. Pre-orders are shipped within 7 business days after the official release date. The expected release date is shown on the product page; if it changes, the customer is informed by email.
The customer may cancel a pre-order at any time before it ships and is then refunded in full. If Card Dream cannot deliver a pre-order, in particular because its allocation from its distributor is reduced, the customer is refunded in full.
6. Payment
Payment is made online when the order is placed, using the payment methods offered at checkout. Payments are processed by secure payment providers; Card Dream never has access to the customer’s card details.
7. Delivery
Card Dream delivers worldwide with DHL or UPS. Parcels are tracked and delivered against signature. In-stock orders are shipped within 2 to 7 business days; pre-orders within 7 business days after the release date. Delivery times then depend on the destination and the carrier.
The risk of loss or damage to the products passes to the customer when the customer, or a third party designated by the customer, takes physical possession of them. The customer is invited to check the parcel on delivery, to note any damage with the carrier and to inform Card Dream as soon as possible, with photos, so that the damaged products can be replaced or refunded.
If the products are not delivered by the agreed date or, failing that, within 30 days of the order, the customer may cancel the order under the conditions of articles L.216-2 et seq. of the French Consumer Code and is then refunded in full.
8. Right of withdrawal
The customer has 14 days from delivery to withdraw from the contract, without giving any reason. To exercise this right, the customer sends a clear statement to hello@cardreamtcg.com, for example using the model form below.
Products must be returned within 14 days of the withdrawal request, complete and in their original packaging. Return shipping costs are paid by Card Dream, which sends the return instructions. Breaking the factory seal goes beyond what is necessary to establish the nature and characteristics of a sealed collectible product: the customer may be held liable for the resulting loss of value.
Card Dream refunds all amounts paid, including the initial standard delivery costs, within 14 days of receiving the withdrawal request, using the same payment method. The refund may be deferred until the products are received back.
9. Legal guarantees
All products benefit from the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code), for 2 years from delivery, and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). Under the guarantee of conformity, the customer may choose between repair and replacement, subject to the conditions of article L.217-12, or obtain a price reduction or a refund in the cases provided for by law.
10. Personal data
Personal data collected during orders are processed by Card Dream to manage orders and customer relations, as described in the Privacy Policy.
11. Intellectual property
Pokémon, Pokémon TCG and related names and images are trademarks of Nintendo, Creatures Inc. and GAME FREAK inc. Card Dream is an independent retailer and is not affiliated with, sponsored or endorsed by these companies.
12. Disputes and mediation
In the event of a dispute, the customer is invited to contact Card Dream first at hello@cardreamtcg.com. If no amicable solution is found, the customer may refer the matter free of charge to the consumer mediator: ANM Conso, 25 allée Rose Dieng Kuntz, 75019 Paris, France – www.anm-conso.com.
These terms are governed by French law. This choice does not deprive the consumer of the protection of the mandatory provisions of the law of their country of habitual residence.
